Q. My home inspector has ordered a mold inspection, how many
molds are indeed toxic. My real estate agent said, 1 in 50, is that true,
is this a racket? [March 15, 2004]
A. Any mold indoors that is present in elevated levels can
cause serious health problems, according to the U.S. Environmental
Protection Agency. It is important that the physical inspection be
thorough, including mold testing of the air of each room, attic, basement,
crawl space, and the outward air flow from each heating/cooling duct
register. Sellers can avoid being sued over mold by finding and fixing
all mold infestation problems before they list their properties for sale.
Buyers can protect both their health and their home investment by always
having a comprehensive mold inspection and mold testing of any property
they are interested in making an offer in [of course, only after a signed
contract is done with a 21 day environmental inspection clause]. Hire a

I am a realtor dealing with
a home on a lake. The home has a crawl space and is in good physical
condition. The wood structure in the crawl space are in good condition
with no evidence of mold.(Plywood Floor and Floor Joist).
The Crawl Space floor is Earth and does have some moisture content, but it
is not wet and there is no standing water. Again this is lake property. A
portion of the Earth in the crawl space has a white crystal coating
(Mold?).
This coating covers Approx. 10 ft. area. Can you tell us any information
concerning this and where to find out more

A. You ought to put the white substance into one of our do it
yourself mold test kits and watch for mold growth over a 7 day time
period. As a precaution [especially because of higher humidity being at
lakeside], you can use do it yourself mold test kits from a large
hardware, home improvement, or safety store, to mold test the
air of each room, attic, crawl space, and the outward air flow from each
heating/cooling duct work for the possible presence of elevated levels of
airborne mold spores, in comparison to an outdoor mold control test which
you should also do. If the substance is mold, the dirt containing
the mold growth should be removed and discarded. Then the entire crawl
space areas should be wet sprayed [timbers and dirt] with at least two
sprayings each of both EPA-registered fungicide
wood protectant. Other mold tips: You ought to put the white substance

Disclosure
A good
statement of the realtor's viewpoint on realtor and seller disclosure
obligations [as to property problems] is this guest editorial by realtor
Lou Boyle in the St. George, Utah, Spectrum, March 4, 2001---
Any disclosure is no better than the
information known to the seller. No seller is required to be an expert in
construction, surveying, hazardous waste or soil conditions. What a
disclosure does do is to inform the buyer of those problems of which the
seller is aware.
According the [Utah] Dept. of Real
Estate, such a disclosure is not a separate "law," but it is
incorporated in the required real estate purchase contract, a form used by
all licensed real estate agents and brokers.
In the event there is a discrepancy
between the actual condition of the property and that which is disclosed
on the seller's disclosure form, the seller would be held accountable for
such discrepancies. This form is the for the protection of both the seller
and buyer.
The real estate agent or broker would
not be responsible for any undisclosed defect in the property, unless the
agent or broker had actual knowledge of any problem with the property.
